Pursuant to the Pennsylvania Clean Streams Law, the Pennsylvania Department of Environmental Protection Rules and Regulations, the Surface Mining Conservation and Reclamation Act, and the Bituminous Mine Subsidence and Land Conservation Act as amended, notice is hereby given that Consol Pennsylvania Coal Company LLC, P. O. Box J, 1525 Pleasant Grove Road, Claysville, PA 15323 is making application to the Pennsylvania Department of Environmental Protection to revise Coal Mining Activity Permit (CMAP) No. 30841316 for the Bailey Mine.
The Bailey Mine is requesting a modification to existing Mining Activity Permit No. 30841316 for the implementation of a stream restoration project. This project is designed to improve stream flow conveyance within a portion of Unnamed Tributary 32596 of the North Fork of Dunkard Fork that overlies the 3 I Panel of the Bailey Mine. The plan incorporates erosion and sedimentation control installation, stream channel stabilization design, geosynthetic clay liner (GCL) installation and biological enhancement structure installation. The project consists of the restoration of approximately 1150 feet of Unnamed Tributary 32596 by using a combination of geosynthetics to seal the stream channel and natural stream design principles. Total proposed earth disturbance will be limited to approximately 1150 feet of stream channel and stream bank.
The proposed project is in Richhill Township, Greene County and can be found on the Wind Ridge, PA U. S. Geological Survey 7.5 minute topographic maps and mapping provided in the permit application. This area can be described as follows:
Specifically Unnamed Tributary North Fork Dunkard Fork 32596 crosses SR 3022 (Bristoria Road) approximately 2100 feet (0.4 miles) east along SR 3022 from the intersection of SR 3022 and SR 021. The project area starts approximately 1200 feet along the stream north of the stream intersection with SR 3022 and extends 1150 feet north.

Pursuant to the Pennsylvania Code Title 25, Section 71.53, notice is hereby given that Consol Pennsylvania Coal Company LLC (CPCC), doing business at P.O. Box J, 1525 Pleasant Grove Road, Claysville, PA 15323, is planning to construct and operate a wastewater (sewage) treatment plant at the proposed Enlow Fork Mine, Oak Spring Slope and Supply Yard Facility located in East Finley Township, Washington County. CPCC will submit Act 537 Sewage Facilities Planning Modules and related permitting information to the Pennsylvania Department of Environmental Protection in order to obtain a permit to construct and operate the facility.
The proposed wastewater treatment plant will be located within the proposed Oak Spring Slope and Supply Yard facility, on the south side of Quaker Ridge Road (T-373), between S.R. 231 (East Finley Drive) and Oak Springs Road (T-458). Effluent from the plant will be gravity discharged into an Unnamed Tributary to Rocky Run. The wastewater treatment plant is designed to treat 2,800 gallons of sewage per day.

Pursuant to the Pennsylvania Clean Stream Law, the Pennsylvania Department of Environmental Protection rules and regulations, the Surface Mining Conservation and Reclamation Act and the Coal Refuse Disposal Control Act as amended, notice is hereby given that Consol Pennsylvania Coal Company LLC, doing business at 1525 Pleasant Grove Road, PO Box J, Claysville, PA, 15243, has made application to the Pennsylvania Department of Environmental Protection to revise Coal Mining Activity Permit CMAP No. 30841317 and related NPDES permit for the Enlow Fork Mine.
The proposed revision adds approximately 26.7 acres of surface permit area for construction of the 3 North 6 Shaft Site. The facility will be located in East Finley Township, Washington County, Pennsylvania and is located on the Prosperity, PA U.S. Geological Survey 7.5 minute topographic map. The proposed permit area begins off of S.R. 3009 (Cracraft Road) approximately 1,200 feet east of the intersection of S.R. 3009 and Walnut Road (T-471) and extends approximately 3,000 feet northeast. The proposed permit revision includes earthmoving activities for the construction of the shaft site, six boreholes, an access road, soil stockpiles, and erosion and sedimentation control structures.
The application includes a request for variance to encroach within 100 feet of the right of way of a section of S.R. 3009 (Cracraft Road) beginning approximately 1,200 feet east of its intersection with Walnut Road and continuing about 160 feet to the east. The road variance is required for construction of the access road, culvert, and erosion and sedimentation control facilities.
Stream variance requests are proposed for 158 feet of Unnamed Tributary EF T4 to Buffalo Creek, located on the northern side of S.R. 3009, beginning approximately 1,200 feet east of the intersection of S.R. 3009 and Walnut Road, and continuing to the east. The stream variance is required for construction of the access road, culvert, and erosion and sedimentation control facilities.
The proposed permit revision includes one new NPDES discharge point from a sedimentation pond into Unnamed Tributary EF T1AA to Buffalo Creek. Unnamed Tributary EF T1 to Buffalo Creek is on the north side of S.R. 3009, beginning approximately 2100 feet east of the intersection of S.R. 3009 and Walnut Road. Unnamed Tributary EF T1AA to Buffalo Creek begins at a location approximately 1300 feet upstream (northeast) along Unnamed Tributary EF T1 to Buffalo Creek. The proposed new NPDES discharge point is located approximately 400 feet north-northwest of the mouth of Unnamed Tributary EF T1AA to Buffalo Creek.
Blasting may be conducted during site grading activities. Blasting will not occur until a plan has been approved by the PADEP. When a blasting schedule is finalized, residents, owners of dwellings or other structures, local governments and public utilities located within 1/2 mile of the area where blasting will occur will be notified. All residents, owners of dwellings or other structures located within 1/2 mile of the area where blasting will occur will be informed of their right to a pre-blast survey and how they may request such a survey.

The proposed revision includes the addition of 87.78 acres to the underground permit area and the underground subsidence control plan area for an underground training center. This area will utilize continuous mining and related equipment for development mining only, and will provide new employees with hands-on equipment training. Training is a major factor in Consol’s safety philosophy of absolute zero accidents, and that safety trumps everything. Consol has 5 training centers throughout the company, and this underground training center will be further enhancement of employee development. The training center will be utilized by all Consol Energy operations, with new employee instruction of hazard identification, risk assessment, and hands-on equipment training, as well as supplemental training for new supervisors. Implementation of the development training section is needed at this time and will begin immediately upon permit approval.

Opfermann Mine NOTICE Neiswonger Construction, 17592 Route 322, Strattanville, PA 16258 proposes to conduct overburden blasting in compliance with all state and federal laws (as written within the “Surface Mining Control and Reclamation Act of 1977”) at its surface coal mining operations located in Somerset Township, Washington County, known as the Opfermann Mine, SMP #63090102. The permit is on lands now or formerly of Robert & Roberta Opfermann and Wilbert & Beverly Obringer. Blasting is proposed between the hours of sunrise and 8:00 AM, 8:00 AM to 12:00 Noon, 12:00 PM to 4:00 PM, and 4:00 PM to sunset everyday except Sunday from June 2010 through June 2011. Warning signs will be placed at every entrance to the operation and three (3) - five (5) second signals of sufficient power to be heard Yo mile from the blast site, will be sounded one (1) minute but no more than 2 minutes before blast will be blown. One prolonged ten second signal of sufficient power to be heard Yo mile from the blast site will be blown as an all clear signal. Rain, lightening, or other atmospheric conditions, or operator, or public safety, are considered emergency situations and may require unscheduled detonation.
